Breve referencia biográfica del autor.

José Diaz Cappa. Fiscal desde el año 1990, desempeña actualmente su función como Fiscal en la Fiscalía Superior de la CCAA de Illes Balears donde es Delegado de Criminalidad Informática así como Delegado de la Sección de Menores y Delegado para la Tutela Penal de la Igualdad y contra la Discriminación. Responsable Coordinador del Sistema de Información del Ministerio Fiscal. Profesor Asociado de Derecho Penal en la Universidad de Illes Balears (UIB) y colaborador desde hace varios años de la Universidad Nacional de Educación a Distancia (UNED) Baleares. Profesor y preparador de los diferentes Fuerzas y Cuerpos de Seguridad del Estado (PN, GC y Policía Local). Es Promotor, organizador, ponente y miembro del Comité Científico de las I, II y III Jornadas Internaciones sobre “Menores en Edad Escolar: Conflictos y Oportunidades” organizadas conjuntamente con la Consellería de Educación del Govern Balear y consideradas de interés para la Carrera Fiscal por la Fiscalía General del Estado. Fue asesor de la Comisión de Derechos Humanos del Parlamento de la CCAA de Illes Balears respecto de los riesgos de los menores ante las nuevas tecnologías. Ponente TAIEX por la Comisión Europea en el curso "Spanish Law on Juvenile Justice" (Macedonia, 2009) y designado para el Proyecto Europeo (Comisión Europea) "Judicial Response to Crime Committed by EU Unaccompanied Juvenile Offenders" (2013-2014). Author’s brief biographical reference.

José Diaz Cappa. Public Prosecutor since 1990; currently acting as Public Prosecutor at the Public Prosecutor’s Office of the Autonomous Region of the Balearic Islands, where he is the Delegate for Computer Crime, Delegate of the Juvenile Division, Delegate for Discrimination Crime, and the person Responsible for the Coordination of the Prosecution Service’s Information System. Associate Lecturer in Criminal Law at the University of the Balearic Islands (UIB) and, since several years ago, a collaborator of the Spanish Open University (UNED); teacher and trainer for the various National Security Forces and Corps (State Police, Spanish Civil Guards and Local Police). He is also a promoter, organizer, speaker and member of the 1^st, 2^nd and 3^rd International Conference about “Minors of School Age: Conflicts and Opportunities”, organized together with the Balearic Government, and being considered relevant for the Public Prosecution career by Public Prosecutor’s Office. He was a consultant of the Human Rights Commission of the Parliament of the Autonomous Region of the Balearic Islands, advising on the risks minors face out of the new technologies. Speaker TAIEX (European Commission) "The Spanish Law on Juvenile Justice (Republic of Macedonia, 2009) and European Project "Judicial Response to Crime Committed by EU Unaccompanied Juvenile Offenders" (Febrero 2013/Octubre 2014). Lo que pretendo brevemente en esta conferencia es descubrir y diferenciar las diferentes manifestaciones y proyecciones de la protección de los datos personales, así como indicar cuándo la relevancia de su intromisión ilegítima tiene consecuencias penales, civiles o, simplemente, administrativas, así como intentar desligar y separar en cada caso conceptos tales como datos personales, intimidad, confidencialidad o secreto que, aunque sinónimos en muchas ocasiones, son, en la mayoría, conceptos muy diferentes, así como son muy distintas las consecuencias de su eventual vulneración.

                     Title of the Paper: “The different aspects of data protection”

The use of new technologies and their impact on the respect to the secret and the personal privacy of the information concerning a sender and a receiver has turned the so called Law on Protection of Personal Data into a sort of recurrent social mechanism to give shelter to any negative justification facing the possibility of using, transmitting or providing the before mentioned personal data, or to turn any situation that may directly or indirectly affect that part of our individual and personal area into  a criminal offence. With the present conference, I intend to reveal and identify, in short, the different manifestations and implications of the personal data protection, as well as to establish when the relevance of its unlawful interference has criminal, civil or mere administrative consequences, as well as to try to detach and separate, as appropriate, concepts such as personal data, privacy, confidentiality or secret, which even being synonyms in many occasions, are, most of the times, very different concepts, being, therefore, the consequences of their possible infringement likewise very different.
